1. Object of the privacy policy

MOVILIZATORIO USA L.L.C. and MOVILIZATORIO S.A.S and CORPORACION MOVILIZATORIO, hereinafter, “MOVILIZATORIO” or the “Company”, domiciled in Colombia, identified with NIT 900884414 - 3 for S.A.S and 901.052.761-8 for CORPORATION, domiciled in the city of Bogotá, will process the personal data of its Petitioners,  Workers and Collaborators in accordance with this policy.  

For this reason, and in compliance with its legal obligations, MOVILIZATORIO as Responsible for the Treatment of personal data, informs you of its Privacy Policy regarding the processing of personal data that it may collect in the course of its activities.

MOVILIZATORIO reserves the right to make, at any time, the modifications, updates or changes it deems appropriate under the terms of this Privacy Policy. Prior to its implementation, the company will request the corresponding authorizations when these changes involve the inclusion of new purposes, processing or changes in the identity of the Responsible.

2. Processing of Personal Data

The collection, processing and subsequent use of personal data by MOVILIZATORIO will be carried out in accordance with the provisions of Law 1581 of 2012, Decree 1074 of 2015 and other applicable regulations.

In this sense, it is necessary that all the holders of the information recognize that, in the course of their relationship with MOVILIZATORIO, they may be asked to provide personal data, including their name, contact information, the history of requests that the Petitioners sign or share, and certain demographic information. Additionally, we store the IP address of Submitters in our databases.

There may be instances where we request information that may lead to insight into the Petitioner's political position or religious inclination, in order to complete a particular application or survey. In no case will it be mandatory to reveal sensitive personal data.

In order for our network to continue thriving, growing and being effective, we collect data from our members and  users of our website so that we can mobilize and communicate with them more creatively and efficiently. This allows us to create, promote, and finance our campaigns, interact with policymakers, our campaign recipients and the media, as well as develop new, more effective methods to grow the MOVILIZATORIO network.

MOVILIZATORIO undertakes to observe and adopt all necessary security measures to ensure the confidentiality, secrecy and integrity of the personal data to which it has access, as well as to adopt as many security measures as are required by the laws and regulations aimed at preserve the secrecy, confidentiality and integrity in the processing of personal data.

MOVILIZATORIO will treat the provided personal data confidentially and undertakes to protect the privacy of all the holders of the information.

3. Purpose of the Processing of Personal Data

MOVILIZATORIO informs that all the personal data provided to it will be incorporated into the corresponding databases, which will be registered in the National Registry of Databases administered by the Superintendence of Industry and Commerce, if necessary.

The information provided by the Petitioners may be used for the following purposes:

  1. Facilitating Petitioners to support and sign a petition or survey, and getting such petition or survey into the hands of the intended recipient.

  2. Verify that the Petitioners are able to sign petitions.

  3. Give the Petitioners the services and information they have requested.

  4. Give the Petitioners the content they request.

  5. Facilitate, request and manage the participation of the Petitioners in the MOVILIZATORIO programs, and in its events and activities.

  6. Know if the Petitioners would like to assist us in our work, campaigns and activities, because they have a role that may be relevant to them.

  7. Process the donations of the Petitioners, or return the money requested by grantees.

  8. Register the Petitioners in MOVILIZATORIO.

  9. Send information about our work via email, phone, text message or social media messaging services. Since the fulfillment of our mission depends to a large extent on who controls the government, our updates and opportunities may include information related to elections or political campaigns.

  10. Show who has participated in the campaign, showing their name and the initial of their last name, their country, and the campaign in which they have participated.

  11. Involve Petitioners in campaigns, fundraisers and special projects, provide them with information about the work of MOVILIZATORIO and make it easier for them to share their initiatives on social networks.

  12. Notify decision makers, state entities, political candidates, news media and the general public when Petitioners sign a petition, send a message through our tools or adhere to a petition.

  13. Create marketing campaigns, focused on promoting our work and involving the public in particular campaigns and requests.

  14. Verify the identity of the Petitioners, and send them an email to thank them for their signature.

  15. Answer their questions.

  16. Manage and improve the website and optimize our technology.

  17. Analyze the use of the site through tools that help us to verify the operation of the content and functionality of the site, understanding traffic patterns, and identifying any problems.

  18. Share the results of the Company with governmental or non-governmental entities and prepare studies and strategies to develop solidarity actions and promote other initiatives.

  19. Create campaigns focused on facilitating the development of the Company's purpose, to advance initiatives tending to promote social, political, cultural or technical actions.

The personal information given by MOVILIZATORIO Workers and Collaborators will be processed for the following purposes:

  1. Execute the contracts that have been entered into with the owners of the personal data.

  2. Contact the owners to send information referring to the contractual and obligatory relationship that may take place.

  3. Manage, maintain, develop, and monitor the existing contractual relationship between the parties, address their information requests, as well as handle their complaints, process their requests for contract termination, and revoke authorization for the processing of personal data.

  4. Manage the queries made by the holders of the information.

  5. Know, store and process all the information provided by the owners in one or more databases, in the format that it deems most convenient.

  6. Order, catalogue, classify, divide or separate the information provided by the owners.

  7. Register the information of the family group of the Company's employees for the fulfillment of the duties indicated by the Law, as well as to make them participate in the welfare activities or benefits provided by the Company.

  8. Control access to the Company's facilities.

  9. Verify, corroborate, check, validate, investigate or compare the information provided by the owners, with any information legitimately available. 

In general, MOVILIZATORIO will process personal data for the following purposes:

  1. Send MOVILIZATORIO information that stands out, related to events, requests, and any other matter that allows the development of the MOVILIZATORIO objective. 

  2. Analyze, evaluate and generate statistical data on MOVILIZATORIO's activity, as well as indicators, results, investigations of the Petitioners' needs and/or any other consideration directly or indirectly related to the Company's initiatives.

  3. Register the data of the holders of the information.

  4. Analyze, process, evaluate, compare the information provided by the owners.

  5. Study, analyze, personalize and use the information provided by the owners for the monitoring, development and/or improvement, both individual and general, of the initiatives tending to promote social actions developed by the Company.

  6. Collect data for the fulfillment of the duties that, as Responsible for the information and personal data, correspond to the Company.

  7. Operate our website, maintain its security standards, and ensure that its content is presented in the most effective manner possible.

  8. Conduct audits and manage our systems and databases.

  9. Fulfill legal obligations, such as those related to the prevention of money laundering and financing of terrorism.

  10. Prevent fraud or inappropriate use of our service. 

In compliance with current regulations, MOVILIZATORIO may cross your data with other databases under the responsibility of the Company, or public databases in order to comply with legal limitations related to the prevention of fraud and money laundering activities, assets and financing of terrorism. In this regard, the operator informs you that you may communicate information regarding the activity of your account to the competent public bodies for the fight against fraud and money laundering and terrorist financing activities in accordance with the provisions of current regulations.

4. Rights of the Holders of Personal Data

The Holders of personal data have the rights recognized by the applicable regulation, which will be guaranteed by MOVILIZATORIO and are described below:

  1. Know, update and rectify your personal data.

  2. Request proof of the authorization granted.

  3. Be informed, upon request, of the treatment given to your personal data.

  4. Submit complaints to the Superintendence of Industry and Commerce for violations of applicable regulations.

  5. Revoke the authorization granted and request the deletion of their personal data.

5. Information to the Owner on the Exercise of their Rights.

MOVILIZATORIO has designated the area of ​​[⦁] [1] as responsible for the processing of requests or claims related to the exercise of rights related to the protection of the rights of its Holders.

The Holder or his successors in title may exercise their rights by e-mail addressed to hola@movilizatorio.org[2] , including in the communication the reference "Protection of Personal Data". In any case, the communication addressed to the exercise of said rights must include the following data of the owner and/or his successor(s): name, surname, and Citizenship ID number or any other legally valid document that proves your identity and request in which the request is specified.

Inquiries

Queries will be answered within a maximum term of ten (10) business days from the date of receipt thereof. Said term will be extended for a maximum term of five (5) additional business days, by means of written communication to the Holder and/or his successors in title, in which the reasons for the delay and the date of response will be informed.

Claims

Claims will be addressed within a maximum term of fifteen (15) business days from the date of receipt of the same in its entirety, as described below.

Any claim must contain a description of the facts that give rise to it, the notification address, and the documents that you want to assert, as annexes to it. In the event that the claim is incomplete, MOVILIZATORIO will contact the Holder within five (5) business days following receipt of the claim so that the failures are corrected within the following two (2) months. The claim will be considered abandoned if it is not completed within said term.

The classification "claim in process" and a description thereof will be incorporated into the file or section corresponding to the Holder in the database involved within two (2) days following receipt of the claim in its entirety.

The response term will be extended for a maximum term of eight (8) additional business days, by means of written communication to the Holder and/or his successors in title, in which the reasons for the delay and the response date will be reported.

In accordance with article 16 of Law 1581 of 2012, the Holder and/or his successors in title may file complaints with the Superintendence of Industry and Commerce only after having made the claim directly before MOVILIZATORIO and the response terms described in this section or a response is received from MOVILIZATORIO, whichever occurs first.

7. Transmissions and Transfers of Personal Data

MOVILIZATORIO may transmit and transfer the personal data for which it is Responsible to third parties. Said third parties may be located in Colombia, or in other countries that, in the opinion of the Superintendence of Industry and Commerce, guarantee an adequate level of protection of personal data, including the United States.
